This contract is entered between Mary’s Mountain Bichons (hereinafter "SELLER") and _________________________________ (hereinafter "BUYER(s)")
BUYER AND SELLER AGREE TO THE FOLLOWING PROVISIONS OF THE SALE:
This Dog is the offspring of registered parents. The Dog can be registered on FULL or LIMITED terms as indicated and agreed upon by the SELLER. Registration papers will be provided to BUYER from SELLER at time of adoption or as soon as received from Registry Service, no later than 30 days from date of adoption or BUYER can return puppy/dog for full refund. Seller guarantees Dog to be in good health, free of known contagious diseases and has had vaccinations/worming required for it’s age at the time of this agreement.
BUYER AGREES TO HAVE THE DOG EXAMINED BY A LICENSED VETERINARIAN WITHIN 48 HOURS (NOT INCLUDING SUNDAYS AND HOLIDAYS) OF RECEIPT OF THE PUPPY.
If the Dog is determined to be in poor health, as evidence by a veterinarian’s statement, BUYER can elect to keep the Dog, assuming all costs for it’s care, or may return the Dog and paperwork within 24 hours for a replacement puppy upon SELLER’S receipt of the veterinarian’s statement regarding the puppy’s health. SELLER reserves the right to have a second veterinarian of her choice evaluate the Dog’s condition before replacement will be issued. This provision will expire 48 hours (not including Sundays and Holidays) after the BUYER takes possession of the Dog.
SELLER guarantees this puppy to be free of all Communicable diseases for a period of ten (10) days from the date of sale on this Pet Record. SELLER also guarantees this puppy to be free of Genetic Defects that make the puppy not suitable for the purpose of a "family / companion pet" until the puppy reaches one (1) year of age. BUYER understands that the following slight genetic defects are not considered serious or life threatening and therefore are not covered: lack of pigment, umbilical hernia, undescended testicle, underbite, or overbite. SELLER makes no guarantee regarding loss of the Dog because of accidental death, theft, sickness, etc., or any other loss beyond SELLER’S contract, except as stated above. If the Dog develops any inheritable/genetic defect within twelve (12) months from the date of birth, BUYER may return the Dog to SELLER for a replacement puppy of equal quality, if and when SELLER has the next litter of puppies. SELLER reserves the right to have a second veterinarian of their choice evaluate the Dog’s condition before the warranty will be honored. BUYER understands that replacement option is only valid when health problems are attributed to a hereditary problem and not due to accident or contagious and/or other illness. BUYER understands that any and all guarantees expire one (1) year from the date of birth.
Also this guarantee shall become null and void if the puppy is given any vaccinations prior to 3 weeks after receiving previous vaccination. SELLER does not guarantee against Parvo, Corona, Coccidiosis or Giardia after 72 hours of purchase.
If this puppy displays any indication of poor health you must notify SELLER by the 10th day following purchase to make a claim for a replacement puppy. If your puppy is very sick or has a congenital defect found by your vet, you will return him/her to the SELLER (at BUYER’S expense) with the registration papers and you must obtain and submit a written statement from your vet, on office stationary and signed by him/her for our records, stating health risk and to include a description of the symptoms supporting his/her opinion to validate this guarantee. Any vet bills incurred to diagnose or repair a problem will be the responsibility of the BUYER unless arrangements have been approved prior to treatment. Failure to do this will cause this contract to be null & void. Under no conditions and at no time during the life of the Dog will SELLER pay or assist in paying veterinary expenses after the Dog is purchased, including any such expenses directly or indirectly related to any inheritable/ genetic defects. Hypoglycemia is not covered by this warranty.
- Original puppy must be returned within 24 hours along with all the paperwork. (You agree to fill out all necessary forms to return ownership of puppy to breeder)
- If you qualify for a replacement, you can choose a new puppy of equal value if one is available.
- If you choose a puppy of greater value than the original puppy, then you are responsible to pay the difference.
- If we do not have a puppy of equal value available within 180 days: for your replacement, we will refund your puppies original purchase price minus shipping and administrative fees.
BUYER shall agree that the Dog will live with BUYER as a house dog, will not be left outside unsupervised, will have adequate exercise, nutritious food and necessary health care from a licensed veterinarian, INCLUDING ALL REMAINING VACCINATIONS, YEARLY VACCINATIONS, including RABIES vaccine. BUYER shall certify, by signing an agreement, that he/she is not acting as an agent in this purchase; that BUYER will not resell this puppy to a pet store or medical research facility. BUYER also agrees that puppy will not be taken into any public situations, i.e., Petsmart, Groomer, Dog Parks, etc. until puppy has received his/her 16 week checkup / vaccinations / rabies.
BUYER understands that the balance due must be paid ten (10) days prior to shipping or by the eighth week of Puppy's age, whichever comes first, unless other arrangements have been agreed to with SELLER. ALL shipping and transportation expenses are the responsibility of BUYER. BUYER gives permission to SELLER to publish testimonials and photos regarding this adoption of puppy.
The BUYER can return the Puppy within six (6) months from the date of sale. Seller must agree. It must be in good health with no defect and a clean bill of health from the SELLER’S veterinarian. Only 50% of the purchasing price will be refunded. The SELLER retains the right of first refusal if at any time in the life of the Dog, the BUYER is unable or unwilling to keep the Dog. BUYER will contact SELLER first. If BUYER finds a new home for the Dog, BUYER agrees to provide SELLER with the name, address and phone number of the new owner.
